TERMS & USE

Welcome to our website. If you continue to browse and use this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Majuscule LLC (dba Majuscule Wine) relationship with you in the context of this website. Majuscule Wine (“We”, “Us”, “Our”) provides wine and related services in compliance with applicable California and federal laws. By using our website or purchasing our wine, you agree to these terms and use.

1. Age Requirements

  • You must be 21 years old or older to purchase or receive any wine or alcoholic beverages from us.

  • By placing an order, you represent that you and any recipient are at least 21.

  • For deliveries, an adult (21+) with valid government ID must sign upon delivery. If the carrier cannot verify age, the delivery may be refused, returned, or held — and you will be responsible for related costs.

2. Compliance With Laws & Labeling Updates

Because laws change, we’ve updated some of our policies. Here are the most relevant ones:

Bottle Bill / CRV (California Beverage Container Recycling Law)

  • Effective January 1, 2024, wine and spirits containers are included in California’s container deposit system (known as the “Bottle Bill”).

  • Producers, importers, and distributors—including wineries that ship direct-to-consumer (DTC)—must register with CalRecycle, report, and pay redemption value (CRV) fees and processing fees.

  • Starting July 1, 2025, all wine/spirit containers sold in California must be labeled with an approved CRV message, unless permanently exempt. The required statements include one of: “California Redemption Value,” “CA Redemption Value,” “California Cash Refund,” “CA Cash Refund,” or “CA CRV.”

  • Containers filled and labeled before January 1, 2024 are permanently exempt from mandatory CRV labeling requirements.

  • Tasting room sales for on-site consumption are exempt from the Bottle Bill’s labeling requirements for off-site containers.

3. Payment & Pricing Policies

  • We pass on CRV and processing fees to customers as allowed by law. We will clearly show them either as part of the price or as a separate line item.

  • We reserve the right to adjust prices at our sole discretion.

4. Returns, Refunds & Damaged Goods

  • Because of state & federal laws, once an alcoholic beverage leaves our premises, we generally cannot accept returns unless the product is damaged, flawed, or spoiled.

  • If you believe a product is defective or not as described, contact us promptly (within 3 days) with photo(s) and a description.

  • If confirmed, we will offer either a refund or a replacement. We may request that you return the item (or part of it) for our evaluation.

  • For items damaged due to adverse weather during shipment, or for user error (e.g. broken in transit after delivery, misuse, etc.), we will not provide a full refund.

5. Shipping, Delivery & Title

  • We comply with federal and California laws concerning shipping alcohol. Some states prohibit direct-to-consumer wine shipments. If your state does not allow direct shipments, we will notify you or cancel the order.

  • You must abide by any special laws in your state concerning imports, taxes, and customs.

  • Title to, and ownership of, all wine passes from Majuscule Wine to the purchaser in the State of California and the purchaser takes all responsibility for shipping it from California to their home state. By arranging for transportation of the wine via common carrier, Majuscule Wine is providing a service to, and acting on behalf of the purchaser. You will be billed for this service. By utilizing this service from Majuscule Wine or our designated third-party shipper, the purchaser is representing that he/she is acting in a fashion compliant with their local and state laws regarding the purchase, transportation and delivery of wine. The purchaser represents that they have obtained any required permission, paid any required fees, is working through properly licensed intermediaries where required, is legally entitled to take possession of wine and is legally entitled to take quantities ordered, and once again authorizes that he/she is 21 years of age.

  • All packages sent from Majuscule Wine via its designated shippers require an adult signature upon delivery. You will be charged a $35 return fee plus the cost of shipping the package back to us if you fail to sign for delivery or the package is rejected by you or any individual at your address. If the carrier is unable to make a delivery due to circumstances beyond their control, you will be responsible for either the carrier’s redirect fee, if applicable.

  • Risk of loss or damage to products passes to you upon carrier pickup. We do not insure wine shipments. Please report any damage immediately (within 3 days) upon delivery.

6. Wine Club Terms & Conditions

  • By joining our wine club, you agree that Majuscule Wine is authorized to charge your credit card for each scheduled shipment.

  • There is no fee to join, no cancellation fee, and no annual membership fee. You must commit to two consecutive wine club orders to receive and maintain your club benefits and before you can skip shipments. If you cancel before your second delivery, you will be charged back for the discounts you received up until your cancellation date.
